Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity.)

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day:

  • on which you or a third party designated by you, who is not the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered together; or
  • on which you or a third party designated by you, who is not the carrier, took possession of the last goods, provided that you ordered several goods as part of a single order and these are delivered separately; or
  • on which you or a third party designated by you, who is not the carrier, took possession of the last partial shipment or the last item, provided that you ordered goods that are delivered in several partial shipments or pieces; or
  • on which you or a third party designated by you, who is not the carrier, took possession of the first goods, provided that you have entered into a contract for the regular delivery of goods over a specified period.

You may also exercise your right of withdrawal online at Cancel Contract (https://nafilia.com/en/cancel-contract). If you use this online function, we will promptly send you an acknowledgement of receipt on a durable medium (e.g. by email), including information about the content of your withdrawal declaration as well as the date and time it was received.

To meet the withdrawal deadline, it is sufficient that you submit your declaration of withdrawal using the withdrawal function (the so-called “withdrawal button”) before the withdrawal period has expired.

You may also exercise your right of withdrawal by informing us (Nafilia UG (haftungsbeschränkt), Karwendelstr. 30, 12203 Berlin, Germany, Telephone: +49 176 45638470, Email: office@nafilia.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, although this is not mandatory.

In this case, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.

You must send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply pursuant to Section 312g (2) of the German Civil Code (BGB) to:

  • contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is essential, or which are clearly tailored to the personal needs of the consumer.
